- The OFFER, that is , once found your dream house , you can negotiate the purchasing price and make an offer to the owner . In case of price
agreement , a little Deposit or CAPARRA will enable you stopping that house in the estate market ( usually 5% of total house price)
- The Preliminary Contract or COMPROMESSO. This is the second steep toward your house! The Vendor and you ( the buyer) fix in a private legal document all the selling details: final price, house description , paties recognition and time of the final deed. Here you will pay to him another part of the final price ( usually 25 %). The Compromesso has to beregistered to local Registration Tax office.
Once both you and the vendor have signed the Compromesso you are both committed to the transfer of the property. You may still withdraw at risk of loosing your deposits. The vendor may also withdraw from the Compromesso but will have to return the deposit plus pay a penalty of the same again.
- The final Notarial Contract or ROGITO included the power of attorney document .The Rogito is a legally binding deed and requires the presence of an official called Notaio or Notary/Lawyer.He oversees the signing of the Contract, registers the Rogito to the Land Registry and collects the tax on the property. Once signed the Rogito the house is finally yours!ial contract)
